The Terms & Conditions of Sale define the conditions which are applicable to any sale concluded between any individual or company (« the Customer ») and the company Mulita SARL (« Mulita ») on the website www.mulita.fr
These Terms & Conditions of Sale must be read carefully and be accepted before you place an order.
Mulita reserves the right to modify its Terms & Conditions of Sale at any time and the conditions applicable are those in effect at the date the order is placed.
1 – Vendor identification
www.mulita.fr is a website of the company Mulita, SARL a limited liability company with a capital of 1.000 euros.

2 – Product presentation
The products proposed for sale are described and presented with as much accuracy as possible. Mulita cannot be held responsible for any mistake or omission. The products are proposed for sale within the limits of available stock.
The photographs illustrating the products are as true as possible. We have taken every necessary measure to supply exact images of each article sold on our site. However, due to various factors, such as Internet navigators, variations in on-screen colour contrasts according and others, Mulita cannot be held responsible for any differences in colour between the image and the real product.
3 – Product prices
Prices are in Euros and include VAT but exclude delivery costs.
For information purposes only, you may use the currency converter to check the value of Euros, Pounds Sterling and US Dollars.
Regarding sales outside the European Union, prices are considered FOB from Paris. Customs clearance and the payment of various rights or taxes are the Customer’s responsibility.
4 – Geographical coverage
Worldwide except countries where delivery is not possible for legal reasons.
5 – Orders
The order placement procedure is as follows:
– selection of product(s) which are added to your basket;
– validation of basket contents;
– identification on the website;
– choice of delivery option and acceptance of Terms & Conditions of Sale;
– choice of payment method;
– confirmation of payment.
6 – Identification
When the Customer places their first order, they have to register by providing their name, address, delivery address (if different from postal address) and email.
In order to make it easier to identify the Customer, the Customer specifically authorises Mulita to save a « cookie » file on the customer’s hard drive. Once an account has been created, the Customer can be identified by simply providing their email address and password.
7 – Payment
7.1 – Methods of payment
The Customer may choose from the following methods of payment:
(CB – Visa – Mastercard – American Express)
The Customer supplies the number of the credit/debit card, expiry date and card verification code (CVC). For certain debit or credit cards, the Customer will receive a security code sent by Société Générale or the Customer’s own emitting bank. This will be sent by SMS and entered by the Customer in the on-screen window.
The Customer accesses the Paypal platform to carry out the transaction (by credit card or via a Paypal account) under the usual conditions and security standards provided by Paypal.
7.2 – Payment security
Mulita uses the secure payment service of the bank Société Générale (Sogenactif) which includes SSL security protocol. Confidential information, such as the 16-digit credit card number, expiry date and CVC are communicated in encrypted form to the bank’s secure server without ever going through the Mulita server.
8 – Order delivery or collection from the Mulita premises
8.1 – Delivery
Delivery is carried out to the address specified on the order form within the agreed geographical area.
The risk is the Customer’s responsibility from the moment the products leave the Mulita premises.
If the goods are damaged during transport, a motivated claim must be made to the transport company, within 3 days of delivery.

- Signed delivery: if you wish, you may request your parcel to be delivered using signed service. Do not hesitate to specify this when you place your order and we will send you the corresponding fees.
- Delivery time :
For information purposes only, delivery time from dispatch is 2 business days
- Collection at the Mulita premises: If you wish, you may collect your order at the agreed meeting time at our retail outlet, 42 rue de l’Amiral Hamelin, 75116, Paris.
International delivery, according to weight; signed service
La Poste « Collissimo – Expert International ».
This modality includes a compulsory signature upon receipt of the parcel. Delivery times are 3 or 8 days from the order placement, depending on the destination.

Nevertheless, if you need an express delivery, Mulita can post your parcels by DHL Express and your parcel will be delivered 24 hrs after posting.
MULITA agrees to dispatch orders no later than five working days following their placement.
9 – Treatment of parcels which cannot be delivered by the transport provider
9.1 Return -Person is not known at the address or the parcel has not been claimed at the Post Office on time.
Mulita will contact the Customer in order to resend their order or proceed to reimburse them.
9.2: Return- Parcel refused at destination
A purchase voucher will be credited into the Customer’s account within 72 hours following Mulita’s reception of the parcel. The Customer must request the cancellation of the voucher and the reimbursement by writing to firstname.lastname@example.org
10 – Exchange (mainland France and Monaco only) or cancellation
The period during which the Customer can request an exchange or exercise his right to cancel the contract is 14 days from the date on which the parcel is received.
If you are exchanging a product delivered to mainland France or Monaco, the return postage fee is paid by Mulita
If you are requesting a refund, the Customer has to pay the cost of return postage
The returned articles should be new and not used.
All exchanges or returns must be requested in writing to the following e-mail address: email@example.com
In the case of an exchange, the Customer will receive by email a link allowing him to print a pre-printed return label to stick on his parcel before dropping it off at the post office of his choice in mainland France
The Customer should keep the proof of deposit stamped by the post office until Mulita has confirmed they have received the returned parcel.
The cost of returning and re-dispatching your goods is free of charge for a maximum of 1 exchange for the same order.
If you ask for a refund, and subject to the observation of the above-mentioned return conditions, Mulita will refund the returned articles within 15 days of the articles being returned to stock. Returned products must be intact and accompanied by their original individual packaging.
11 – Guarantee
The products supplied by Mulita are covered by the statutory guarantee provided for by articles 1641 and following of the French Code of Civil Law.
Any complaint, request for exchange or refund must be lodged by email at: firstname.lastname@example.org
12 – Liability
In the online selling process, the vendor’s only obligation is to exercise due care; the vendor cannot be held liable for any damage resulting from the use of the Internet network.
At all the stages of access to the website, consultation, form filling, order placing, article delivery or any other service, the only obligation of the company Mulita is to exercise due care.
Consequently, Mulita cannot be held liable for any inconvenience or damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, interruption of service, or any other problems which are unintentional and have nothing whatsoever to do with the diligence and precautions taken by Mulita.
13 – Intellectual property
All the components of the Mulita website are and remain the exclusive intellectual property of Mulita.
No one is permitted to copy, show, broadcast or use any content of the website, whether it be software, visuals or sound, for any other purpose whatsoever, even partially. Any simple or hypertext link directing to the Mulita website and using framing, deep-linking, in-line linking techniques or any other deep-link technology is strictly prohibited without the prior written agreement of Mulita.
14 – Personal data
In accordance with the French Act N° 78-17 on Data Processing, Data Files and Individual Liberties of 6th January 1978, the nominative information concerning the buyer can be the object of automatic data processing.
The buyer can object to the disclosure of his personal data to third parties by informing Mulita of this objection. The users also have a right to access and rectify personal data pertaining to them, in accordance with the aforementioned Act of 6th January 1978.
The automatic data processing operations carried out by Mulita, including the management of website users’ email addresses, are the object of notification N° 1846353 v 0, made to the CNIL on 25th March 2015.

15 – Archiving – Proof
Mulita will archive sales orders and invoices on a reliable and durable storage medium, representing a true copy, in accordance with the provisions of article 1348 of the French Code of Civil Law.
16 -Settlement of disputes
The present Terms & Conditions of Sale shall be governed by and construed in accordance with French law. In the event of dispute, the Customer irrevocably submits to the exclusive jurisdiction of the competent court of the city where Mulita has its head office, notwithstanding the plurality of defendants or the introduction of third parties.
